b) the mandatory warranty based on the law

Act V of 2013 on the Civil Code (PTK);
Government Decree 151/2003. (IX. 22.) on the mandatory warranty for certain durable consumer goods;
Government Decree 45/2014 (II.26) on the detailed rules for contracts between consumers and businesses;
19/2014. (IV. 29.) NGM Decree on the procedural rules for handling warranty and guarantee claims regarding goods sold under a contract between a consumer and a business
Scope, acceptance, change of the GTC
The content of the contract concluded between us is determined – in addition to the provisions of the relevant binding legal acts – by these General Terms and Conditions (hereinafter: GTC) and further information on the website. Accordingly, these GTC contain the rights and obligations of you and us, the conditions for concluding the contract, the deadlines for performance, the delivery and payment terms, the liability rules, and the conditions for exercising the right of withdrawal.
You are obliged to familiarize yourself with the provisions of these GTC before finalizing your order. By purchasing through our online store, you accept the provisions of these GTC, and the GTC is fully part of the contract concluded between you and the Seller.
The Seller is entitled to change the provisions of these GTC within the framework of the relevant legal acts. Please read the provisions of the GTC before making any purchase! Any modification of the GTC is valid from the moment it is published on the website. Any changes do not affect contracts already concluded (confirmed orders).
Language of the contract, form of the contract
The language of the contracts covered by these GTC is English.
The contracts covered by these GTC are not considered written contracts and are not registered by the Seller.

The prices are in HUF, our products include 0% VAT. The prices are for informational purposes only, we reserve the right to change prices.
Complaints handling and legal remedies
The consumer may submit consumer complaints regarding the product or the Seller's activities to the following contact details:

The consumer may communicate his complaint to the enterprise orally or in writing, which concerns the conduct, activity or omission of the enterprise or a person acting in the interest or on behalf of the enterprise directly related to the distribution or sale of the goods to consumers.
The enterprise is obliged to immediately examine the verbal complaint and, if necessary, remedy it. If the consumer does not agree with the handling of the complaint or if it is not possible to investigate the complaint immediately, the enterprise is obliged to immediately record the complaint and its position on it and, in the case of an oral complaint communicated in person, to hand over a copy of it to the consumer on site. In the case of an oral complaint communicated by telephone or using other electronic communications services, it is obliged to send the consumer a substantive response within 30 days at the latest - in accordance with the provisions relating to the response to a written complaint. Otherwise, the enterprise is obliged to proceed as follows with regard to a written complaint.
The enterprise is obliged to respond to a written complaint in writing on the merits - unless otherwise provided for by a directly applicable legal act of the European Union - within thirty days of its receipt and to take measures to communicate it. A shorter deadline may be established by law, and a longer deadline may be established by law. The enterprise is obliged to justify its position rejecting the complaint. The enterprise is obliged to provide an individual identification number for an oral complaint submitted by telephone or using an electronic communication service.
The minutes of the complaint must include the following:
the consumer's name and address,
the place, time and method of submitting the complaint,
a detailed description of the consumer's complaint, a list of the documents, records and other evidence presented by the consumer,
a statement by the enterprise on its position regarding the consumer's complaint, if immediate investigation of the complaint is possible,
the signature of the person taking the minutes and - with the exception of oral complaints submitted by telephone or other electronic communication services - the consumer,
the place and time of recording the minutes,
in the case of oral complaints submitted by telephone or other electronic communication services, the individual identification number of the complaint.
The undertaking shall keep the minutes of the complaint and a copy of the response for five years and shall present them to the supervisory authorities upon request.
In the event of rejection of the complaint, the undertaking shall inform the consumer in writing of the authority or conciliation body with which the complaint may be initiated, depending on its nature. The information shall also include the registered office, telephone and internet contact details and mailing address of the competent authority or the conciliation body at the consumer's place of residence or stay. The information shall also include whether the undertaking will use the conciliation body to resolve the consumer dispute.
The application must include
the consumer's name, place of residence or residence,
the name, registered office or relevant establishment of the undertaking concerned by the consumer dispute,
if the consumer wishes to request jurisdiction instead of the competent conciliation body,
a brief description of the consumer's position, the facts supporting it and their evidence,
a statement by the consumer that the consumer has attempted to resolve the dispute directly with the undertaking concerned
a statement by the consumer that no other conciliation body has been initiated in the matter, no mediation procedure has been initiated, no claim has been filed or a request for a payment order has been submitted,
a motion for the board's decision,
the consumer's signature.
The application must be accompanied by the document or its copy (extract) the content of which the consumer refers to as evidence, in particular the written statement of the enterprise rejecting the complaint, or, failing that, by other written evidence available to the consumer about the attempt at the required conciliation.
If the consumer acts through an authorized representative, the authorization must be attached to the application.

Online Dispute Resolution Platform
The European Commission has created a website where consumers can register, allowing them to resolve their disputes related to online purchases by filling out a request, avoiding court proceedings. This way, consumers can enforce their rights without being prevented, for example, by distance.
If you want to make a complaint about a product or service purchased online and do not necessarily want to go to court, you can use the online dispute resolution tool.
On the portal, you and the trader against whom you have made a complaint can jointly select the dispute resolution body you wish to entrust with handling the complaint.

Partial invalidity, code of conduct
If any point of the GTC is legally incomplete or ineffective, the remaining points of the contract shall remain valid and the applicable provisions shall apply instead of the ineffective or incorrect part.
The Seller does not have a code of conduct under the Act on the Prohibition of Unfair Commercial Practices Against Consumers.

Correction of data entry errors - Responsibility for the accuracy of the data provided
You have the opportunity to modify the data you have entered during the order process before finalizing the order (by clicking the back button in the browser, the previous page will open, so the data entered can be corrected even if you have already moved to the next page). Please note that it is your responsibility to ensure that the data you provide is entered accurately, as the gold bracelet will be invoiced and delivered based on the data you provide. By placing your order, you acknowledge that the Seller is entitled to charge you for all damages and costs resulting from your incorrect data entry or inaccurate data. The Seller excludes liability for performance based on inaccurate data entry. Please note that an incorrectly entered e-mail address or the storage space belonging to the mailbox may result in the failure to deliver the confirmation and may prevent the contract from being concluded.
Procedure in the event of an incorrect price
It may happen that - e.g. due to a technical error - an incorrect price is listed on the website. In the event of an incorrect price, we cannot accept the order (your offer) at the incorrect price, and we are not obliged to sell the product at the incorrect price. In the event of a bid at an incorrect price, no contract will be concluded between us. If you make a bid at an incorrect price, the system will automatically confirm it, but this does not constitute acceptance of the bid on our part. In the event of a bid (order) by you at an incorrect price, the Seller’s employee will draw your attention to the correct price and may offer to conclude a contract at the correct price. You are not obliged to make a bid at the correct price announced by the Seller instead of the incorrect price and conclude a contract. In this case, no contract will be concluded between the parties.
Using the website
Selecting a product
The customer has the opportunity to choose or order from the products in the store. The customer can view a more detailed description of the selected gold bracelet by clicking on it. If they intend to purchase, they place the product they want to purchase in a virtual basket by clicking the "Add to Cart" button. By clicking the "View" button in the Basket, they will find the products they added to the basket during the purchase, as well as the total amount of the invoice and the shipping costs. Here they can check the correctness of their order, especially with regard to the prices and quantities, which they can modify or correct as needed. The basket automatically calculates the total amount of the order.
Submitting the order
If you consider the quantity of products placed in the basket appropriate, you have checked the total amount and decided that you would like to purchase them, simply click on the "Proceed to checkout" button. You can then choose whether you want to log in as an existing customer, register as a new customer, or purchase without registering.
If you have previously purchased from our store, enter your email address and password from your previous registration. If you want to register as a new customer, enter your purchase details, which will be stored by the system and you will only need to log in the next time you make a purchase. If you purchase without registering, enter your name, phone number, billing and shipping address.
In the next step, select the delivery method and payment method that suits you. If you agree with the content of the order and accept the Terms of Purchase (i.e. these GTC), click the “Order” button to submit your order.
Finalizing the order (placing an offer)
If you are satisfied that the contents of the basket correspond to the gold bracelet you wish to order and that your details are correct, you can finalize your order by clicking on the “Order” button. The information provided on the website does not constitute an offer to conclude a contract on the part of the Seller. In the case of orders subject to these GTC, you are considered the offeror, and the contract is concluded upon the Seller’s acceptance of the offer you made via the website in accordance with the provisions of these GTC
By clicking the “Order” button, you expressly acknowledge that your offer shall be deemed to have been made and that your statement – if confirmed by the Seller in accordance with these GTC – entails a payment obligation.
Order processing, conclusion of the contract
You are bound by your offer for a period of 48 hours. If your offer is not confirmed by the Seller within 48 hours according to these general terms and conditions, you are released from the obligation to make an offer.
You have the option to place an order at any time. The Seller will confirm your offer by e-mail no later than the working day following the sending of your offer. The contract is concluded upon the Seller’s acceptance of your offer.
Payment methods
Bank transfer
The bracelet will be sent by post after the transfer has been credited to the Service Provider’s bank account. The consumer can make the transfer after adding the product to the cart and finalizing the order, based on the automatic confirmation received by e-mail.

The consumer has 7 calendar days after receiving the email confirmation to transfer the purchase price. If the purchase price is not received within 7 days, the order will be canceled, which the consumer will be notified of by email.
Bank card payment
Bank card details are not transferred to Tolnaiarany.hu, the transaction takes place 100% on STRIPE's secure website. In case of successful payment, STRIPE will redirect the customer to Tolnaiarany.hu, the order will be marked "Paid", and the product(s) will be shipped within 2-3 business days at the latest.

Cash on delivery (only in Hungary)
In the case of cash on delivery, the buyer pays the delivery person the purchase price and the shipping costs at the same time, in cash or by bank card, upon receipt of the goods.
Parcel machine orders can only be placed on site with a bank card.
Collection methods, collection fees
Home delivery in Hungary - GLS
Shipping fee is free only in Hungary.
The gold bracelets will be delivered by GLS to the address provided within 2-4 business days of the order.
Flexible delivery:
GLS notifies the recipient of the parcel delivery and offers several delivery options.
The recipient is notified by SMS or email after ordering the parcel delivery.
The first notification contains all the important details of the parcel, the contact details of the customer service and a direct link to the GLS Delivery Manager website. On the online interface, the recipient can choose from a number of delivery options. For example, they can choose a new delivery date, enter a different address or redirect the parcel to a GLS Parcel Point.
The second email/SMS notification is sent on the morning of the delivery day, when the courier receives the parcel and assigns it to the expected delivery within the 3-hour time window. This message also contains the courier's phone number and the contact details of the customer service.
If the first delivery attempt was unsuccessful, the recipient is automatically notified by email or SMS. The message contains the link to the GLS Delivery Manager website, where you can select the next delivery method.
The FlexDeliveryService service also includes a third delivery option if necessary.
With the FlexDeliveryService service, recipients can actively participate in the logistics process, which not only contributes to successful delivery, but also significantly increases the quality of customer service.
You can pay at the delivery person in cash or by bank card in Hungary. The courier does not check your identity, if the package is recognized and accepted at the specified address, he will hand over the package.
Delivery cost:
Free in Hungary.
FOREIGN COUNTRIES:
Carriers, delivery fees, delivery time information can be checked at order process, before payment.
Delivery time in Hungary
The general delivery time for orders is a maximum of 2-4 working days from the date of order confirmation. This delivery time is for information purposes only; any deviation from this will be notified by e-mail or the telephone number provided. By accepting these general terms and conditions, you acknowledge that the Seller expressly excludes any liability for damages due to exceeding the specified delivery time.
Reservation of rights, ownership clause
It may happen that some products on our website are no longer available due to a technical error. In view of this, we reserve the right to reject already confirmed orders in part or in full. Partial delivery can only take place after consultation with you. If the purchase price of the product is paid in advance, the amount will be returned to you within 2 working days.
The gold bracelet remains the property of the Seller until the purchase price and shipping costs are paid in full.
Right of withdrawal and exchange guarantee
Right of withdrawal
The customer may withdraw from the contract without giving any reason within 14 days of receipt of the product. The customer may exercise the right of withdrawal from the day on which he received the goods. The Service Provider is obliged to refund the amount paid by the customer, including any shipping costs, immediately, but no later than thirty days after withdrawal.
Enforcement of the right of withdrawal
1. Consumer notification
The consumer shall notify the Service Provider that he wishes to exercise his right of withdrawal at the following e-mail address: tolnaiarany@gmail.hu
To identify the order, the consumer must provide the following data:
- name and e-mail address provided at the time of purchase;
- the Order number and the article number of the product(s) (can be found in the order confirmation email, in the case of multiple products, please indicate all article numbers);
- the consumer's bank account number, to which the purchase price is requested to be refunded.
2. After fulfilling the obligation described in point 1, the consumer is obliged to return the entire contents of the package received, i.e. the purchased gold
bracelet, the gift box, the invoice, and any gifts received, within 14 days.
The Service Provider's postal address: 4031, Debrecen, Kishegyesi út 156.A. A. ép. II/8., the consumer is obliged to return the package received by courier service.
3. Refund of the purchase price within 2 working days
If everything has been returned to the specified address in its entirety and without damage, the Service Provider will refund the full purchase price, including shipping costs, to the bank account number provided by the consumer within 2 working days. The refund of the purchase price is always made by transfer to a bank account.
The customer shall bear the costs incurred in connection with the return of the gold bracelet due to the exercise of the right of withdrawal. The customer shall not be charged any other costs. However, the seller may demand compensation for damage resulting from improper use of the goods. If the goods returned under the right of withdrawal are not in a perfect, resaleable condition, the customer is liable for compensation if the deterioration, destruction or other impossibility of returning the goods was caused intentionally or through negligence.
If, during the opening of the product, in the presence of the person performing the delivery (postal delivery person, courier), it is found that it is proven to be damaged, and the damage occurred before the receipt of the goods, we will immediately ensure the return of the gold bracelet and the cancellation of the sale. Any damage or lack of content during the delivery of the shipment must be included in the report of facts between the sender and the recipient. The Service Provider is not responsible for any subsequent lack of content or damage.

Exchange guarantee
The customer may exercise the exchange guarantee without giving any reason within 60 days of receiving the gold bracelet. The customer may exercise the right to the exchange guarantee from the day on which he received the goods.
Validation of the exchange guarantee
1. Consumer notification
The consumer notifies the Service Provider that he/she wishes to use the exchange guarantee at the following e-mail address: tolnaiarany@gmail.com
To identify the order, the consumer must provide the following data:
- name and e-mail address provided at the time of purchase;
- the Order number and the article number of the product(s) (can be found in the order confirmation email, in the case of multiple products, please indicate all article numbers);
- the consumer's bank account number, to which the purchase price is requested to be refunded.
2. After fulfilling the obligation described in point 1, the consumer is obliged to return the entire contents of the package received within 14 days
i.e. the purchased gold bracelet, the gift box, the invoice, and any gifts received.

3. Refund of the purchase price within 2 working days

If the returned gold bracelet is not in perfect, resaleable condition, the customer is obliged to pay compensation if the deterioration, destruction or other impossibility of returning the goods was caused intentionally or through negligence.
If, during the opening of the product, it is found in the presence of the person performing the delivery (postal delivery person, courier) that it is proven to be damaged, and the damage occurred before the receipt of the goods, we will immediately ensure the return of the product and the cancellation of the sale. Any damage or lack of content during the delivery of the shipment must be included in the report of facts between the sender and recipient. The Service Provider does not assume liability for subsequent lack of content or damage.
Warranty
The Seller provides a warranty for all new jewelry according to the statutory limits:
a) 1 year for products between 10,000-100,000 HUF
b) 2 years for products between 100,001-250,000 HUF
c) 3 years for products over 250,000 HUF. (Government Decree 151/2003 (IX.22.))
The invoice, which serves as a warranty card, is attached to the gold bracelet.
Any defect that is a consequence of a manufacturing defect in the product is covered by the warranty.
Damage caused by the Consumer as a consequence of the Consumer not following the handling rules described in the Jewelry Care Guide attached to the jewelry is not covered by the warranty.

Exercise of warranty right:
1. Consumer notification
The consumer notifies the Service Provider that he/she wishes to exercise his/her warranty right to the following email address: tolnaiarany@gmail.com
The following must be included in the email so that the order can be identified:
- the name and email address provided at the time of purchase;
- the Order number and the product(s) article number (can be found in the order confirmation email, in the case of multiple products, please include all article numbers);

3. Seller sends the repaired jewelry to the Consumer
If everything has arrived intact, Seller will send the repaired jewelry to the address provided by the Consumer within approx. 3 weeks (depending on the time required for the repair).
If the jewelry sent cannot be repaired or would involve disproportionate costs, Seller will refund the original purchase price of the jewelry to the Consumer to the bank account number provided by the Consumer.
